Macedonia's Special Prosecutor's Office has filed a motion to the Criminal Court on Tuesday for a search warrant and for the custody of the person G.G., holding a high position at the so-called Fifth Directorate, i.e. the Administration for Security and Counter Intelligence which operates in the frames of the Interior Ministry.
The following day, the Criminal Court announced it rejected the search warrant motion, whereas in relation to the detention motion, it sent an invitation to the person to report to the court for a hearing.
"In relation to the search warrant motion that states that the order should be issued for the purpose of retrieving traces of criminal acts and items, the authorization of the Special Prosecutor's Office has to be first and foremost determined whether the concrete objects that are expected to be found during the search are related with the content of the illegally intercepted communications," the court's press release reads.
Also, according to the Court, the search warrant motion did not contain a precise description of the items whose revoking is requested, but general terms were used relating to objects that could be found in anyone's home.
In relation tot he proposal of sentencing the person G.G. to detention, the Court sent him an invitation to report on Wednesday for a hearing.
"Given the fact that the person to whom the proposal refers to did not appear before this court, the judge, in line with the Law on Criminal Procedure, under which measures on securing the presence of persons and uninterrupted course of the criminal procedure on the persons are prescribed, has sent an invitation the person to report at the court's premises," the press release adds.
After the person's hearing, the court will pass an additional decision to timely inform the public.
