
Special Public Prosecutor's Office informed that the Appellate Court - Skopje has accepted SPO's appeal against the decision of Basic Court Skopje 1, which denied the request to deliver copies of the documents and electronic evidence of the "Coup" case, and annulled the Court's decision.
"In its decision, the Appellate court accepted all appeals of the SPO, and confirmed that the Basic Court did not have a valid legal base to relate to the SPO as an authorized prosecutor in the procedure, because the council of the Appellate court believes there are no legal obstacles the documents and evidence to be delivered to the SPO as a photocopy," the SPO's report read.
The council of the Appellate court stated that the appeal contains ground facts that the basic court, upon making a verdict for the request did not take into consideration the stipulations of the Law on classified information and the Decree on administrative security and of classified information, therefore the Appellate court evaluated the necessity of the authorized prosecutor to own copies of the evidence, as justified.
"The request of the public prosecution are based on a law, and there are no legal obstacles for their permission. Thus, the delay of the main hearing for this case cannot be SPO's fault, which acts professionally and responsibly in the framework of the laws," the report of the SPO read.
The SPO had a permission to review the evidence, but it needed the copies, to prepare for their introductory speech.
The "Coup" case charges Zoran Zaev, Zoran Verushevski, his wife Sonja, Branko Palifrov (official of Strumica Municipality), and Gjorgi Lazarevski (Interior Ministry employee), for wiretapping and espionage.
